These Terms of Service govern your use of the services offered by Clicko, a business based in Montréal, Québec: website creation and hosting, the prospecting dashboard (prospect.clicko.ca), the AI phone receptionist (app.clicko.ca) and Clicko Reviews. By creating an account, subscribing or using our services, you accept these terms.
You must provide accurate information and keep your login details confidential. You are responsible for the activity on your account, including the actions of the team members you invite.
Subscriptions are billed monthly in advance, in Canadian dollars, through Stripe. Prices, taxes and any free trial are shown before you subscribe. You can cancel at any time; cancellation takes effect at the end of the current billing period and no partial month is refunded, unless the law requires otherwise. Website projects may be covered by a separate agreement, which prevails for that project.
You agree not to use our services to break the law, to send messages to people who did not consent to receive them, to impersonate anyone, to publish false or misleading content, or to interfere with the security or operation of the services.
You confirm that you are authorized to manage the Google Business Profiles you connect. You must follow Google’s policies. In particular, you must not offer incentives for reviews, ask only satisfied customers for reviews, or post fake reviews: review requests sent through Clicko go to every customer you add, with the same link.
You are responsible for the customer contact details you import and confirm that you obtained the consent required by Canada’s Anti-Spam Legislation (CASL).
Some features generate content with artificial intelligence (review replies, call answers, messages). AI can make mistakes. You are responsible for reviewing the content published or sent on your behalf and for the settings you choose, including automatic publishing. You can turn automatic features off at any time.
Our services rely on third parties such as Google, Twilio and Stripe. Your use of their features is also subject to their own terms. We are not responsible for changes to, or interruptions of, third-party services.
You keep ownership of the content and data you provide. You grant us the right to use it only to provide the services. Clicko keeps ownership of its software, dashboards and templates.
We work to keep our services available and reliable, but we do not guarantee that they will be uninterrupted or error-free. To the extent permitted by law, our total liability is limited to the amounts you paid us in the 12 months before the event giving rise to the claim, and we are not liable for indirect losses such as lost profits. Nothing in these terms limits the rights granted to consumers by Quebec’s Consumer Protection Act.
We may suspend or close an account that breaks these terms, after notice when reasonably possible. You may close your account at any time. Your data is then handled as described in our Privacy Policy.
Our Privacy Policy explains how we collect, use and protect personal information, including Google user data.
These terms are governed by the laws of Québec and of Canada applicable there. Any dispute falls under the jurisdiction of the courts of the judicial district of Montréal, unless the law provides otherwise. These terms are available in French and English; in case of discrepancy, the French version prevails.
We may update these terms. We will notify customers by email at least 30 days before a significant change takes effect. If you do not accept the change, you may cancel before it takes effect.
